Bill to eviscerate New Mexico employee’s whistleblower rights protection introduced into Legislative session


The Albuquerque Journal reports today that a bill to totally overhaul the New Mexico Whistleblower Protection Act is being introduced into the Legislature. The bill would weaken the current law’s protection for public employees who report illegal and improper state government conduct.

Most notably, the bill would require an employee to prove that their legally protected whistleblowing activity was the sole cause of any retaliation by the employer, a much more restrictive requirement than most employment law claims require, which is to show that it was a motivating, but not the only reason for the employer’s action.
